Sigwo Terms of Service
Effective Date: October 15, 2025
Welcome to Sigwo ("we," "us," or "our"), a platform providing secure communication services, including SMS messaging powered by third-party providers such as Twilio Inc. ("Twilio"). By accessing or using our services (the "Services"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("ToS"). If you do not agree, do not use the Services.
1. Description of Services
Sigwo enables Users to send and receive messages, including SMS/MMS, for legitimate business and personal communications. All messaging is subject to Twilio's Messaging Policy, Acceptable Use Policy ("AUP"), and Terms of Service, incorporated herein by reference. You agree to comply with these policies, including obtaining prior express written consent for marketing messages, honoring opt-outs, and avoiding prohibited content (e.g., spam, illegal activities, or high-risk categories like cannabis or debt collection without proper registration).
2. User Responsibilities and Compliance
You are solely responsible for your use of the Services and the content of all messages sent or received. You must:
- Ensure all messages comply with applicable laws (e.g., TCPA, CTIA guidelines) and Twilio's policies.
- Obtain and document verifiable opt-in consent before sending messages, including clear disclosure of message frequency and opt-out instructions.
- Identify yourself as the sender in every message.
- Promptly process opt-out requests (e.g., via "STOP" keyword) and suppress future messages to opted-out numbers.
- Not use the Services for prohibited activities, including but not limited to fraud, phishing, or evading carrier filters.
- If you are a platform provider (e.g., ISV), require your end-users to adhere to these same requirements.
Failure to comply may result in suspension or termination of your account, message blocking, or legal liability, for which Sigwo bears no responsibility.
3. Opt-Out and Preferences
To stop receiving Sigwo messages, reply "STOP" to any SMS from our short code or long code. We will confirm your opt-out via a final message. You may opt back in by re-subscribing through the original process. Message and data rates may apply; contact your carrier for details. You will receive approximately 1 message per week, or as your project dictates. For help, reply "HELP" or contact support@sigwo.com.
4. Privacy
Your privacy is important. Please review our Privacy Policy at https://www.sigwo.tech/privacy for details on data collection, use, and sharing, including with Twilio. By using the Services, you consent to such practices.
5. Prohibited Use
You agree not to use the Services in violation of the Twilio AUP, which prohibits illegal, harmful, or objectionable content, even if consented to. This includes no security testing (e.g., simulated phishing), misinformation, or high-volume spam. Sigwo reserves the right to monitor usage for compliance and training purposes.
6. Disclaimers and Limitation of Liability
The Services are provided "AS IS" without warranties. Sigwo disclaims all warranties, express or implied, including merchantability and fitness for purpose. We are not liable for interruptions, lost data, or third-party actions (e.g., Twilio or carriers). Sigwo is not responsible for User content or End-User disputes.
7. Termination
We may suspend or terminate your access for violations. You may terminate by contacting us.
8. Governing Law
These ToS are governed by the laws of Missouri, without regard to conflict of laws principles. Disputes shall be resolved in Missouri Southern Division, Western District.
9. Changes to ToS
We may update these ToS; continued use constitutes acceptance. Notice will be via email or the platform.

By using Sigwo, you confirm you are at least 18 years old and have authority to bind your organization. This ToS, along with our Privacy Policy, constitutes the entire agreement.
